Policy 3601 – Law Enforcement and Government Agencies in KUSD
The School Board and District employees shall cooperate with local, state and federal law enforcement and government agencies in matters involving the education, health, welfare and safety of students, staff and the community. Such cooperation shall occur in a manner that protects student and staff rights, maintains trust with families, and complies with all applicable laws.
Access by Law Enforcement and Government Agencies
Local, state and federal law enforcement officers or other governmental agency representatives seeking access to students or staff during the school day shall be subject to this policy and all applicable visitor management procedures outlined in Policy 1600 – Visitors, except as otherwise required by law.
Access to students and staff shall only be granted subject to valid legal authorization deemed acceptable by the principal, principal’s designee or another supporting administrator authorizing such access. Acceptable documentation may include custody orders, subpoenas, arrest warrants, signed judicial warrants, or parental/guardian consent, as applicable.
The District reserves the right to delay or deny access to students or staff until proper documentation is reviewed and verified. Such verification may include consultation with the District’s legal counsel. The principal, the principal’s designee, or another supporting administrator may impose conditions on approved access to ensure student and staff safety, minimize disruption to the educational environment, and protect student and staff rights and privacy under state and federal law.
Questioning of Students
Local law enforcement officials may request permission to question students during school hours for legitimate purposes, including investigations involving the student. Permission for such questioning may be denied when circumstances warrant, as determined by the principal or their designee.
Except where otherwise prohibited or not required by law, questioning of students by local law enforcement officials shall occur in the presence of the principal or the principal’s designee. Unless otherwise provided by law, parents/guardians shall be notified when their child is questioned by local law enforcement.
